The Town Council of Winona Lake, Indiana met in a regular session on Tuesday, August 28, 2007 in the Town Hall at 7:00 a.m.   Councilpersons noted as present or absent:

OTHERS PRESENT:            Craig Allebach, Pete O’Connell

 

Town Council President Dave Delp called the meeting to order.  He opened in prayer and led the pledge of allegiance. 

 

Minutes:

 Jerry Clevenger made a motion to approve the minutes of the August 14, 2007 Council Meeting and also the minutes of the Executive session held on August 16, 2007.  Jeff Carroll seconded the motion.  The motion passed.

Floor Topics:            

            Storm Water:  Bill and Sherry Winn presented a request to the council.  They reside at 1865 Park Avenue. There is a field behind their home that has had water problems for as long as the Winn’s have lived there; at least twenty years.  Recently they moved a house into that field and also purchased a couple of cottages along Lakeshore Drive.  The placement of the house in that field has made the water problem worse.  Mr. Winn said that he could run a storm sewer line down the alley behind his home to tie into the storm sewer on Park Avenue.  He would like the council to consider placing a storm sewer line down the alley to help solve the problem and also a storm sewer along the easement near the cottages he purchased.  Larry Long stated that potentially a storm sewer line could be placed in the alley, although it would be very shallow with the minimum requirements.  The Council agreed to look at the situation to see what would be involved and what can be done in the area.

 

 Ordinance 2007-8-1 Accident Report Fees:

            Currently the cost of a copy of an accident report from the police department is $5.00.  Town Marshal Paul Schmitt is recommending the cost be raised to $10.00.  This is similar to the fee of other departments in the area.  Accident reports can now be purchased online for $12.00.  Rolly Ortega made a motion to consider this ordinance for passage on the first reading.  Jeff Carroll seconded the motion.  The motion passed with a unanimous vote.  Jeff Carroll made a motion to pass Ordinance 2007-8-1.  Joy Lohse seconded the motion.  The motion passed.


 

Resolution 2007-8-2 Appointment of Reserve Officer:

            Town Marshal Paul Schmitt is recommending that Randy Bowman be appointed as a reserve police officer.  He has served as a reserve officer for other departments in the area so he is already trained.  The budget will support the additional reserve officer.  Joy Lohse made a motion to appoint Randy Bowman as a reserve officer.  Jeff Carroll seconded the motion.  The motion passed.  He will be sworn in at the next meeting.

 

Take Home Cars for Police Department:

            Currently the Town Marshal and the K-9 officer are allowed to drive the police vehicles to and from work.  Paul Schmitt is requesting that the other three officers be allowed to drive their vehicles to and from work also.  Two of the officers live in Winona Lake and the other one lives near the hospital.  Paul feels that response time will be much faster for the officers if they have their vehicles already with them.  Rolly Ortega made a motion to approve the request.  Joy Lohse seconded the motion.  The motion passed.

 

Reports from Supervisors:

            250 East:  Overall the construction is going well.  There have been a few complaints from residents of Heritage Lake.  Some drivers try to get around the construction by driving through the subdivision.  There is no outlet. 

            Greenway Trail:  There is a safety issue at the end of the Greenway Trail where it exits onto Roy Street.  The stop sign at the end of the trail is being ignored by cyclists who are riding into the street, sometimes into the path of motorists.  On the other hand, the cyclists are complaining that drivers are speeding in this area. 

            Enabling Ordinance:  Dave Delp mentioned that an enabling ordinance was introduced and discussed a few meetings ago.  The ordinance has been dropped from the agenda. 

           

             The meeting was adjourned to the streets at Stonehenge.
